From 21 December 2001, new amendments to the Privacy Act 1988 (Commonwealth) govern the ways in which private sector organisations use, collect and disclose personal information.
This privacy policy sets out the principles that Australian Motorsport Club Ltd and its related bodies corporate will follow in the management of the personal information of individuals.
Privacy Policy
Australian Motorsport Club Ltd (“AMC”) is committed to protecting the privacy of individuals’ personal information. AMC is bound by the National Privacy Principles set out in the Privacy Act 1988 (Commonwealth) (“the Act”). AMC will only collect, use or disclose personal information in accordance with the Act and this privacy policy.
“Personal information” means information or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about a person whose identity is apparent, or can be reasonably ascertained, from the information or opinion.
AMC will, from time to time, collect and use personal information. The types of personal information collected and the purposes for which that personal information will be used will depend on the circumstances.
AMC will not disclose personal information of an individual to third parties except:
where third parties appointed by AMC require access to personal information held by AMC to perform services for AMC (in which case AMC requires these third parties to keep that personal information confidential and not to use or disclose it for any purpose other than the purpose of performing those services);
to related bodies corporate of AMC in accordance with the law;
where AMC is required or authorised by law to disclose personal information, for example to law enforcement agencies; or
with the individual’s consent.
AMC will take all reasonable steps to protect all personal information held by it from misuse and loss and from unauthorised access, modification and disclosure.
Any person may seek access to personal information which AMC holds about that person and AMC will provide access to that information in accordance with the Act. There are certain exemptions which may apply to the provision of that information. AMC may charge an administration fee for granting access to information.

Spam
AMC ensures that any commercial electronic messages it sends to people’s email accounts or to their mobile phones (for example, advertising a product or a service) comply with its obligations under the Spam Act. AMC obtains the consent (express or inferred) of intended recipients before it sends such messages, identifies itself as the sender, and includes instructions in all such messages so that a recipient is able to notify AMC if they do not wish to receive commercial messages or advertisements from AMC in the future.
In circumstances where AMC provides factual (and not commercial) electronic messages, or comes within any other exception to the requirements of the Spam Act, it will identify itself as the sender of the message and will provide its contact details.
Car Park Disclaimer
Patrons Entering Australian Motorsport Club Car Park
1. You enter and use the Australian Motorsport Club (“AMC”) Car Park at your own risk.
2. AMC is not liable for you or any person with you for:
a. Injury to you or to anybody else.
b. Damage to, destruction of, theft of or unauthorised delivery up of your vehicle whether authorised or not; or
c. Damage to, destruction of, theft of or delivery up of any property (including anything in or on your vehicle or any other vehicle); however caused, and you release and indemnify us from any claim which you might otherwise have against AMC.
3. You agree to indemnify AMC, in respect of any claim made against AMC as a consequence of, in relation to, or in any way arising out of use of the AMC car park.
4. A parking fee is payable each time a vehicle enters the AMC car park.
If you bring a vehicle into the AMC car park, you agree to pay the parking fee set by AMC from time to time.
a. AMC has the right to retain your vehicle until it is provided with a valid parking ticket or evidence of ownership or entitlement to receive the vehicle which, in our opinion, is satisfactory to AMC; and
b. If AMC deliver your vehicle to anyone in accordance with Clause 5 and 6, AMC will not be liable to you even if the person taking the vehicle does not have your authority.
6. AMC will not be liable to you for delivery of your vehicle to any person who did not have authority to take your vehicle.
7. You agree to:
a. Produce, when requested by AMC, your parking ticket as proof of payment of the parking fee;
b. Not to cause any obstruction;
c. Not to park anywhere that we designate as a no parking area; and
d. Not to use the AMC car park for lighting barbecues, playing ball games or other instructions we may give.
8. If you breach any part of Clause 7 above, you will be requested to leave the premises immediately.
9. While in the AMC car park, you must comply with all reasonable directions and requests made by AMC.
10. AMC has the right, at its discretion, to move your vehicle (including moving it to any location out-side the AMC car park), even if your vehicle is locked. If your vehicle is moved, these conditions continue to apply. AMC is not liable for any damage caused to your vehicle when it is removed.
11. These conditions may only be altered by a written agreement between you and AMC.
12. If any of these conditions are illegal or unenforceable, the offending part is to be disregarded and does not affect the remaining part.
13. In these conditions references to:
a. “AMC” and “its”, mean Australian Motorsport Club Ltd ABN 62 064 367 504, its employees, agents and independent contractors; and
b. “your vehicle” includes a vehicle driven, or intended to be driven, by you into the AMC car park.
Motorsport Disclaimer
In exchange for being able to attend or participate in an event held at Calder Park Raceway/Thunderdome, (and as a condition of the purchase or issue of a Australian Motorsport Club Ltd (AMC) ticket), you agree:
- To release AMC, the Australian Auto-Sport Association, promoters, sponsor organisations, land owners and lessees, organisers of the event, race teams, competitors, their respective servants, officials, representatives and agents (collectively, the “Associated Entities”) from all liability for my death, personal injury (including burns), psychological trauma, loss or damage (including property damage) (“harm”) howsoever arising from your participation in or attendance at the event (including any negligence on the part of the Associated Entities), except to the extent prohibited by law;

That the Associated Entities do not make any warranty, implied or express, that the event services will be provided with due care and skill or that any materials provided in connection with the services will be fit for the purpose of which they are supplied; and
-
To attend or participate in the event at your own risk.
And you acknowledge that;

The risks associated with attending or participating in the event include the risk that you may suffer harm as a result of:
- Motor vehicles (or parts of them) colliding with other motor vehicles, persons or property;
- Acts of violence and other harmful acts (whether intentional or inadvertent) committed by persons attending or participating in the event; and
- The failure or unsuitability of facilities 9including grand-stands, fences and guard rails) to ensure the safety or persons or property at the event.
Motor sport is dangerous and that accidents causing harm can and do happen and may happen to you.
You accept the conditions of, and acknowledge the risks arising from, attending or participating in the event and being provided with the event services by the Associated Entities.
Patrons, AMC are committed to ensuring your safety while you are enjoying the events at Calder Park Raceway. In the unlikely event of an emergency and for your safety during your visit, it is essential that all persons follow instructions as provided over the PA system. Messages will be provided to patrons by PA. Please do not drive from the complex unless advised otherwise. Thank you for your patronage.
Merchandise Statement
The Australian Motorsport Club Ltd merchandise web site is operated by Australian Motorsport Club Ltd ABN 62 064 367 504 ("AMC"). Calder Park Motorsport, Calder Park Raceway, The Thunderdome, is owned and managed by AMC.
The shop on-line terms & conditions and returns policy are set out below:
1. The images are for illustration purposes only. Not all images are an accurate representation of the product listed.
2. All prices quoted are in Australian Dollars (AUD) and inclusive of GST where applicable.
3. All care is taken to ensure that pricing is current and accurate at the time of up-load. AMC will not be responsible for any typographical errors and reserves the right to amend and vary the content of the web site including prices.
4. Prices quoted are only available on-line.
5. The estimated delivery time is two weeks from the date of making the on-line purchase.
6. AMC Guarantee:
When shopping at the AMC merchandise web-site, we ask customers to please choose carefully.
If you are not satisfied with the product purchased at the AMC web-site, then subject to the conditions set out below, you can return the product(s) within 21 days of delivery and we will exchange, replace it or refund your purchase price.
Customers should note that you may also have additional rights under the Trade Practices Act or state equivalent legislation. The terms and conditions set out herein are in no way intended to limit your rights under those laws.
(a) Where you wish to return the product under the AMC Guarantee, you are required to arrange return of the Product to AMC within 21 days from the date of delivery of the product.
(b) When returning the product, you must send each product back to AMC in its original condition and packaging (eg: tags/labels from clothing/apparel merchandise must not be removed). You must also arrange to send to AMC the receipt proving you purchased the product in question from the AMC merchandise web site (eg: this invoice will be received with delivery of the products).
(c) Where more than 21 days have elapsed since you received the product, subject to applicable laws, AMC reserves the right not to accept return of such a product, unless the manufacturer’s warranty applies and you can show the product is faulty or otherwise unsatisfactory through no fault of your own.
(d) AMC is not required to process a replacement, exchange or refund until we receive the product in question from you.
(e) Cost of returning the product to AMC is borne by the customer unless the return is for a faulty product.
(f) To return the product, please call our customer service line on (03) 9091 0800 during business hours and we will advise you of the steps to be taken.
7. Information collected from customers purchasing products from the AMC merchandise web-site will be used for the purposes of processing your order and may also be used by AMC for the purpose on forwarding future product releases and up to date information relating to AMC events.
